Dedicated to supporting the civil justice system on behalf of its members and their clients, the American Association for Justice (AAJ) recently published a study called The Truth About Forced Arbitration. The study looked at forced arbitration claims data from two major US arbitration providers, JAMS and the American Arbitration Association (AAA), over the course of 5 years. The report revealed that AAA and JAMS average about 6,000 arbitration claims each year, and about 6 percent of those cases attain a monetary award of some kind. That equates to 382 individuals winning monetary awards as the result of forced arbitration cases each year, which is fewer than the number of individuals struck by lightning.
In a press release announcing the report, the AAJ said the study shows forced arbitration offers too much protection to corporations while taking away the rights of American citizens. The report goes on to provide more information on how forced arbitration negatively impacts Americans, including the two sectors that leverage forced arbitration clauses the most: financial services and employee contracts. Additionally, it demonstrated that minorities, women, and underserved individuals who do not earn high salaries are the most commonly affected parties.
